Legal Question in Credit and Debt Law in Texas
What to do with debt of a dying family member.
I have a grandmother who due to illness, we don't expect to be with us for more than 8 months. She has approximately $6000 in credit card debt. She is the sole person listed on the cards. Should we be concerned with paying off this debt? What will happen to it after she departs and do we need to provide anything to the creditors?

The creditors may look to her estate for repayment of the debt. You (or whoever will be the executor of her estate) should send notice of her death to the creditor. If her estate is entered into probate and administration, notice of appointment of the administrator should be sent to the creditor as well.
If her estate is negligible, the creditor will probably just write off the debt. The only time the administrator may be liable for the debt is if the creditor files a claim, the administrator denies the claim, and distributes the estate when there was sufficient value in the estate to satisfy the debt. Other than that, the heirs or other relatives are not responsible for her credit card debt.
