Legal Question in Credit and Debt Law in Texas
Deceased member of the family - Automobile liability
We allowed a vehicle that was in my Father's name only, to be repossessed after being advised that we did not have to pay the amount owed. We were told were are not liable since none of our name are on the actual contract on the automobile. The will never went to probate, so there no legal document binding my mother to the automobile. Can the company that holds the loan do anything to my mom?

The company could open a probate as a party interested in the estate of your father and pursue a deficiency judgment on the assets of the estate. The homestead is not available to satisfy this claim, but other valuable personal propery could be.
