Legal Question in Criminal Law in Texas

Frustrated!

After speaking with a police officer regarding my options to recover some property (auto), a police convinced me to file ''burglary of habitation'' charges on a guy that was living with me at the time. He told me how to answer his questions. I had made myself very clear that all I was interested in was recovering the property but because of some prior criminal history and my naivety, the officer was determined to get the DA to pick up these charges. He told me that I would get the property back if I did what he told me to do. Within the next week, the property was returned but when I tried to get the charges dropped, they wouldn�t listen to me. They said that they believed he would eventually hurt me and didn�t care about whether the charges filed were invalid or not. They thought he was bad and deserved to be in jail. This does not seem to be justice to me. I do not know what to do. He is indigent and cannot afford an attorney. What do we do? He is facing 25 to 30 years for something he did not do.

Despite your recitation that you were coerced into telling this story -- the fact is that you are an adult, and you lied in a criminal investigation to recover what appears to be a civil debt. Now you say that an innocent man is going to jail because of your statements. You better be prepared to testify that you made the whole thing up. You might want to hire an attorney yourself.
