if it's your first offense and you get caught what is the maximum and minimum penalty?

Unfortunately, you are not charged with grafiti in Texas, you can be charged with Criminal Mischief, and the punishment is then based on the amount of damage that it caused as result of the offense. For example, if the offense is considered a Class B misdemeanor if the amount of damage or loss is $50 or more but less than $500; or A class A misdemeanor if it the damage loss is more than $500.00 but less than $1500.00 and so on. A class B misdemeanor carries a punishment range of not more than 180 days or 6 months in the county jail, or a fine of up to $2000.00 or both fine and jail. A class A misdemeanor carries a punishment range of up to one year in the county jail or a fine of up to $4000.00, or both fine and jail, etc.

It depends on how much damage they are alleging. If the amount is less than $500, the maximum jail time is 180 days. $500-$1500 - max jail time is 1 year in jail. Give me a call to discuss or send me an e-mail.
