How to prevent being extradited from Maryland to Texas for marijuanna possesion, of which I posted bail for in 2004 and never returned

If Texas is determined to extradite you, there is a valid warrant, and you are the person named in the warrant, then you will probably not prevail fighting extradition. The question then becomes whether Texas want to invest whatever it would cost for deputies to come to Maryland and escort you back to Texas for marijuana possession as opposed to a violent crime.

If Texas does not want to pay the cost, then Maryland would have to release you, but Texas' warrant remains outstanding. You will ride the arrest merry-go-round each time you have contact with law enforcement.

Consider consulting a Texas criminal defense attorney to find out what you are facing. If you were inquiring about a Maryland warrant for marijuana, I would advise you to consider surrendering, instead of having the warrant periodically "dog" you for the rest of your life.

If you want to challenge the extradiction hearing, then you need a lawyer in the county in which you are jailed. If you want to challenge the underlying offense (marijuana possession) you need a lawyer in the county in which the charge is.
