Legal Question in Criminal Law in Texas
Missing court date due to incarceration
My daughter has a court date scheduled, but was recently arrested and is in custody in another county. We won't have the money to bail her out in time to make her original court date but will have it after that. What needs to do done at this point? We don't want to waste money bailing her out if she is going to be extradited to the original county? Please help, the date is fast approaching.

Re: Missing court date due to incarceration
What county is she in? What are all the charges?
Re: Missing court date due to incarceration
Most likely what will happen is that once your daughter takes care of the charge in the current county, then she will be transfer to the other county to take care of that charge. If you have any other questions, please feel free to e-mail me.

Re: Missing court date due to incarceration
You -- or her attorney -- need to advise the court that she is in custody in a different county. The court will verify that information, then either transfer her themselves, or reset the court date, due to her incarceration.
This way there is no messy paperwork later regarding a failure to appear on the first charge. If she had a bond on the first charge, notify the bondsman as well.
