Legal Question in Criminal Law in Texas

Question on a scenario

I am writing a fictional script and I need some information. Please help if you can. What would happen to a man legally in the following scenario:

The husband comes back to his hotel room to find an intruder on top of his naked wife. The intruder tells him he's unarmed and tries to run away. The husband catches him and attacks him. The intruder pleads with him to just call the police. The husband accidentally kills him from beating him. Later it is revealed that the intruder was actually 16 years old, unarmed, and was simplying attempting to rob them.

What would happen to the husband most likely?

Re: Question on a scenario

In Pennsylvania it would depend on whether the husband's use of force was reasonable. Most likely the District Attorney would be inclined not to prosecute because the husband could not know the intruder's age or intent.
