Legal Question in Criminal Law in Texas
serve time on probation violation
My brother has been on probation for 4-5 months. he received 10 yrs probation for manuf. w/ intent to deliver methamphetamines 14gms on a 20 yr sentence. This was his 1st offense. He just got arrested for another posession charge 1 gm methamphetamines two days ago-as well as no registration,no insurance, invalid driver's license.This obviously revoked his probation.He is being held without bond. He is a very nonviolent person, has a history of suicide attempts and is his own worst enemy. What is an educated guess of the options he's looking at in Hopkins County Texas.Is there any way he can receive some drug rehabilitation -since that is problem in life. Or will he get TDC time that would not be helpful to his future at all.He is threatening suicide in jail-what steps do they take to make sure he doesn't accomplish that and what rights do we have as family to assure that doesn't happen?

As a family you have no rights, but if you want to help him, retain an attorney for him. It is sometimes possible, in these clear drug addiction cases to get the APO, ADA and Judge to agree to extend probation with long-term residential treatment facility in lieu of jail time. It sounds like his best option, assuming the new charges are valid ones.
