Charged DWI but not Proof

My daughter was charged with a DWI, maryajuana she was released on saturday and monday (3days) she went and had a drug test done and they found no eviedence of drugs. the D/A can not find any lab results from her arrest. I would think they would have to drop the charge and how long can this go on resetting.
