First Offense DWI

I was recently arrested for DWI. First offense no priors for anything except 1 speeding ticket, three years ago for going 72 in a 65. Paid, the fine then, went to defensive driving and that was it. What are the chances that I will have to spend time in jail? I am really worried about that. There was no other offense other than the DWI. I am newly married, have 5 kids and am very scared. Also, the fact we have 5 kids, all under driving age, I am worried about losing my license due to having to get kids to different places at the same time. If I go to jail and lose my job, our lives would be ruined. I messed up and I expect there to be ramifications, but was just wondering about the chance that I will have to actually spend time in jail. I have never been in trouble before and I am just very worried. I was very cooperative with the arresting office and I am very sorry for what happened.

You are probably elibible for a probation if you plead guilty or found guilty by a jury. However, you might want to talk with a lawyer to determine if the police officer(s) performed their duty in the prescribed manner. a case can sometimes be thrown out if the officer did not follow proper procedure and many times they don't.
