Legal Question in DUI Law in Texas

defered judification

i was arrested in may for a DWI. My friend, who is a sheriff said that i should try to get it defered since this was my first offense. I was wanting to know if this was possible and what steps do i need to take to do so. Do i need an attorney?

You need to talk to an attorney who handles DWI, because DWI has various punishments, fines, surcharges and suspensions that most people do not realize. Your friend unfortunately, does not know what he is talking about, because DWI is one of two offenses that a person is not entitled to Deferred Adjudication. You can thank Mothers Against Drunk Drivers for taking that punishment alternative away. If you were arrested in May, I hope you asked for an Administrative License Revocation Hearing to save your drivers license from being suspended. I cannot emphasize enough, of the fact that you need to talk with an attorney rather than police officers about your case.

I have told many clients the cops are not lawyers they do not always know the law! You need to hire an experienced attorney a DWI can and will effect the rest of your life. There is no Deferred Aduj. for DWI. If you need any more help contact me! Be careful it is your future.
