Hello there,
People have been charged with DWI even though they have not been arrested. This usually happens whenever there is a car accident and one is in the hospital.
The State usually gets a sample of your blood and sends it to their lab to be evaluated to determine if there was alcohol or drugs in your system.
But, you should receive notice that a warrant has been issued for your arrest. Once you receive that notice make arrangements for bail.
DWI's are very complex cases and you need to hire an attorney that focuses their practice on DWI's.
You should consider hiring an attorney that is a member of the National College of DUI Defence. Members of this College are held to a higher standard and have to participate in the Colleges Training. Go to NCDD.com

Yes you can. The usual way someone gets charged with DWI is being arrested at the scene of a traffic stop by a police officer.
