DWI Charge in Texas
My husband had a motor vehicle accident. The police found empty cans in his truck. He refused the breath test. Due to injuries, he was in ICU for 3 weeks-the other people were slightly injured (chiropractor) and settled for 48,000 from our insurance company. He was charged with DWI. He has never been in ANY trouble before-ever. Is there a chance he could serve any jail time? He has turned himself in and is on a bond. The charge is for a Class B Misdemenor DWI. We are terrified. Any help is appreciated.

Hello there,
I would like to know if the other people were injured. If so this case can be elevated to a felony intoxication assault. If it stays as a class (b) he is only looking at a punishment range from zero days to one hundred and eighty days and up to a two thousand dollar fine. Additionally, if he doesn't have a felony on his record he is eligible for probation.
But you need to hire a DWI defense lawyer, not just your regular run on the mill criminal lawyer.
