During a DWI trial the machine ate the tape. The DA went and got a copy to use. Can they do that, the original tape evidence was destroyed.

The would have to present testimony that the copy was true and correct copy of the original and that it accurately represented the scene. Unless the machine also ate the officers, this should not be a problem fro them
