The time period had nothing to do with it. DWI offenses start out as a class B misdemeanor and get enhanced. The second DWI is a class A misdemenaor with a maximum penalty of a year in jail and maximum fine of $4000. The third DWI is a state jail felony with a maximum sentence of 2 years in a state jail and a maximum fine of $10,000. Typical fines vary with the county the offense will be tried in. Whether there was an accident, the level of damage and the level of intoxication all factor into the sentence. San Antonio is on the strict side but it is unusual for DWI offenders to be sentenced to the maximum.
