Legal Question in Family Law in Texas

My boyfriend and I recently broke up and we have 2 children together but we don't have any legal custody papers yet, if he goes and picks the kids up from daycare without my consent is there anything I can do?

If paternity has not yet been established, then the boyfriend is legally a stranger to your children, and he has no more right to get them from daycare than I do. My first question is: Why do the daycare folks release the children to him? What would happen if Charles Manson showed up and wanted to drive off with your children? Your first conversation should be with the daycare folks. You might consider finding a new daycare facility.

The next thing you should do is file a paternity suit. If he wants to be a father so much, let him start sending you child support every month. That will really make him feel fatherly.
