Legal Question in Family Law in Texas

My boyfriend has recently (last 5 months) lost custody of his daughter. There was some risky behavior going on, he lost his job and we were having major problems. After 4 months of persuading he went to seek help and has now been diagnosed with bi-polar disorder. Back in January his biological mother was granted emergency custody. She has a terrible history of being a mother but was the best choice at the time. He wants to regain primary custody over time, but there is a hearing in the next couple of months for permanent custody. Is there any chance he can defer the permanent custody to get time to recover? The child does have a good bond with her grandma and is safe where she is he just doesn't want it to be permanent. Any ideas?

You need to hire an attorney.

In Texas, at some point the court must issue a "final" order. Otherwise, the case is dismissed. I assume in this case the judge does not want this case dismissed.

When he gets settled he can ask the court to modify the court order.
