Legal Question in Family Law in Texas
I have a child who came into my life after the mom disappeared for 5 years. I had discovered she was pregnant back then but she left and claimed the child was not mine. 5 years later I get a letter in the mail requesting child support. Flash forward a few months and the child is my son and I am paying my child support and following everything stated in the custody arrangement with one exception... Medical insurance..
The court documents state that "reasonable cost" based on my income is 250/mo for my child's insurance... When I went through the process of adding him I discovered it was going to be well over 500 more every month to add him on the insurance alone (this amount does not include child support).
I am in the process of seeking private child only coverage for him but I have run into a few issues. His mother, dispite my efforts, has yet to provide me with his SSN which is a necessity to apply for insurance. I have the court documents naming me as the father but his birth certificate was signed by another man (now deceased).
My questions are:
1. Can she take me back to court to be found in contempt for not having coverage in the time stated in the original documents (they have been in effect for 4 months)
2. How can I retrieve his SSN if the mother will not release it to me and I didn't sign the birth certificate

1. Yes, she can sue you for not having the required health insurance coverage.
2. The child's social security number should show up somewhere in your documents - the paternity order, or the wage withholding order. See if you can look at the court's file. Some counties have online access to court documents. If this is not the case in your county, you will need to go downtown.
