Legal Question in Family Law in Texas
Conflict of interest? I am going through a divorce. One of the lawyers at the law firm my wife is using is our ex Sunday school teacher. I feel that will ruin my reputation and apperance with the people we both know.
1 Answer from Attorneys
First and foremost, please keep in mind that if you wife has retained an attorney, that attorney is under an attorney-client privilege. While your wife may communicate unfavorable comments about you to her attorney, her attorney is limited in what he/she can repeat. The Texas Disciplinary Rules of Professional Conduct Rule 1.05 provide for confidentiality of information. If attorneys at your wife's firm discuss you and your wife's case with others, they may be in violation of the Texas Rules of Professional Conduct. If you do believe that they have violated this rule, those attorneys may be at risk to be disciplined by the Texas State Bar.
