infidelity and have proof
Just learned my common law/ex-husband has been having an affair with my sister. Our home where I have lived for 11 yrs. is under his name, was his before I married him. He is currently in China, and would like him to leave the home, due to his violent tendencies, there is a history of violence. I am afraid of his return and him throwing me and my 16 yr. old daughter out in the street. He's angry cause I just caught him. He is very wealthy and am afraid he'll use his power to take everythiing.

Get yourself an attorney ASAP so they can take action before he does. I'm certain he has been consulting with an attorney on how to get the best of the situation. Don't doubt it; only a fool doesn't have an attorney in these situations.

Based on your zip code, I don't think you are in Harris County, Texas.
You need an attorney in your county to file ASAP a divorce with temporary orders.
You need to talk to an attorney to determine if you have a common law marriage. Just living together is NOT enough to be common law in Texas.
