Modify Parent-Child Relationships

My child's father's Parents are trying to get custody of my daughter. It was a mutual agreement she stay with them until I could get back on my feet, as they said they were trying to help me out. Now I had her come back home to Kansas and enrolled her in preschool, they then asked if they could spend a couple more weeks with her if they brought her back by a certain time, I agreed only after having her father sign,print, and date a statement saying they would return her I have residential custody, meaning she lives with me and her dad has visitaion, they are now trying to take custody in another state is this legal?

If they had possession of her for at least 6 months, then they can file for custody in Texas.
