Legal Question in Family Law in Texas

My step daughter is 13. I have raised her in my comon law marriage for 8 years. Her birth mothers rights were taken away by the court before her 1st birthday but now wants to step in again. What are my rights?? I have been her mother for 8 years. And is there any grandparents rights for her birth moms mom??

If you still have possession of the child, you can hire an attorney and file an original suit affecting the parent-child relationship. You probably have the right to do so under section 102.003(a)(9) of the Texas Family Code.

That provision gives you some rights based on the fact that you've been raising her, which is a legally more persuasive argument than trying to exercise rights as a grandparent. Grandparent rights are very narrow and are listed in section 102.004.
