Legal Question in Family Law in Texas

My wife left Texas with my 2 small children . She went to Kentucky to visit family, after three weeks she told me she was not coming back and she wanted a divorce. What can I do about my children.

Immediately file for divorce in Texas. Then, if she has filed in KY, challenge the KY court's jurisdiction over the matter, because she probably has not been there long enough for the courts in KY to assume jurisdiction over the divorce.

Next, set a temporary orders hearing in Texas for the purpose of having the children returned to TX. Then, serve her with the petition and notice of the temporary orders hearing.

You'll need an attorney in Texas who really knows family law and interstate proceedings and you'll need to act quickly before she's there long enough for the KY courts to assume jurisdiction.
