Legal Question in Family Law in Texas

My ex wife has a son from a previous relationship that has not lived with her in over a decade, he also does not live with his father or family. I just recently found out that she has been receiving child support for this child all of this time and keeping it, is this even legal??

Yes, it is "legal." If you read the child support order, it probably does NOT make the receiving of child support contingent on the child living with Mom.

There may come a day when she is sued by the person who actually lives with the child and has been providing a home for him.
