Who should defend in motion to rehear

We had a hearing on lender liablity and have filed a motion to rehear. The loan was transferred to another lender prior to rehearing. Should the new lender defend in motion or should the original lender appear in rehearing? The new lender has answered the motion. If it should be the original party what do we do?
