Legal Question in Civil Litigation in Texas

Discovery in Small Claims Court

An electric gate at an apartment malfunctioned and damaged my vehicle. As a Plaintiff in a Small Claims Court case, I was told by the Court Clerk I would need to use Discovery for obtaining written records from the Defendant. I can't find any info on what steps to take. What is Discovery and what exactly do I do to obtain the info I need? Do I serve the apartment manager where the accident occurred? Do I type up a letter or is there a form? The court clerks could not give me any info.

Re: Discovery in Small Claims Court

Go to your county law library and ask the librarian to point out the form books. That will get you started.

It will also give you an idea of how trial lawyers make their living.
