I ordered a tombstone, when delivered it was not done right? Can I get a refund legally?

Yes. Demand a refund (in the form of a PAPER letter - don't use email or text messages, and do NOT call anybody on the phone). Give them a time limit (say 10 days). Give them an address where they can mail your refund check.
