Is a statement made in an email considered a contract

My exhusband decided that he had overpaid me for my interest in our home. He harrassed me about the money until, in an emotional moment, I made a statement in an email that I would pay him $35,000 in July of 2007 when I have a CD maturing. Can he hold me to this statement, does it amount to a contract between us? The money was freely given to me prior to the divorce which he did not contest. He is threatening to sue me, can he win?

A contract may be made in email. Whether your statement could be considered a contract, or an enforceable promise, is open to question.

Can he sue you? Yes.

Can he win? Possibly. But the odds are in your favor.
