Legal Question in Civil Litigation in Texas

Sucker punched

Whom would I contact in regard to being hit first with a pool stick by one

drunk, and with a fist by his friend. I was not fighting and was not even

looking nor in any regard defending myself when a clearly inebriated person

stuck me. Either the establishment or the antagonizers should be held

accountable. I received five stiches above my eye and have a shiner only a

hockey player could be proud of. Thanks

Re: Sucker punched

See a lawyer in your area who is proficient in premises liability cases. In the meantime, see an eye doctor to determine if there is any damage to your eye.

Re: Sucker punched

Hopefully, you have the name and address of the drunk who punched you. Clearly he will be liable for your damages. However, is is doubtful that he will have any property from which a judgment can be paid, unless he was a rich drunk.

The establishment will be liable unless only if you can show that it was negligent in some manner. The mere fact that the incident occurred is not proof of negligence. On the other hand, if you can show that the establishment knowingly harbored a dangerous drunk pool player, that will be some evidence of negligence.
