Legal Question in Civil Litigation in Texas

verbal agreements

A cellist wanted me to play violin at some weddings with her. The cellist had scheduled to play at 4 weddings this spring. I had no involvement in planning or organizing the details of the weddings. I was not copied on any emails, nor did I ever sign any agreements. The couples also did not sign any agreement or contract. If there was any contract, I was unaware of it. We played 2 of the 4 weddings. I informed the cellist 3 weeks before the next engagement that I would no longer be willing to play with her. She did not find a replacement and assumed that I would play the next 2 weddings. I suggested that she get another violinist or I knew of some other musicians who was interested in the gig at the same rate that we were to be paid. The bride wants to take me to small claims court now. She hired different musicians at the rate of $400. We were to play for $200 and she is requesting the difference of $200 be paid to her or she will sue.

Re: verbal agreements

Let her sue the cellist. You didn't have any contractual obligation to the bride. It's doubtful that you had any contractual obligation to the cellist, but that's not a foregone conclusion.
