Legal Question in Immigration Law in Texas

fiance visa

i filed for a fiance visa for my fiance from the phils . i included the name of his 2 kids both 11 and 8 in the petition.his marriage is annuled and the children lives with her.how does it go with the immigration if she won`t let the kids go with their dad(she doesn`t even want the kids to vacation with him).it`s okey for him to come over first.would he still be approve if ever? thank you for your time.

In order to take the kids to the USA, he will need a permission of the children's mother. If mother who has custody of the children does not give such a permission, the kids will not be able to emigrate to the USA with their father.

If the marriage was annulled (not ended in divorce), then I assume that the children were left in sole custody of their mother?
