Legal Question in Immigration Law in Texas

my friend is a non citizen from mexico, but had a child with a citizen. she has decided to leave to her country due to abuse and mistreatment from her boyfriend and his family. he won't allow her to leave with the child. is this legal?

A father has parental rights as well as the mother. If they are not married, he couldn't petition for her. If not married, she can't self-petition as an abused wife.
