Legal Question in Immigration Law in Texas

h1b problem...any attorney can help!!

Hi all, The situation I am in right

now, I don't know how to come out

of this?...I need ur help here asap...

OK, so I studied in usa and my f1

visa is stamped till 2011. I got my

h1b approved last year i.e. oct

2008(I did not go out so its not

stamped, just I-797). I worked with

one of the consultancy firm till the

end of March. Then we had some

disputes regarding pay for the

month of March so I complaint to

DOL and he went ahead and inform

USCIS to cancel my H1b. I applied

for COS to b1/b2 which I come to

know before a weak that its denied.

Question:

What is the best way that I can be

in status without going out of the

country?

Also I have a part time offer from

one of the employer, is h1b transfer

is possible now?

Since your application to change status to B2 was denied, you are out of status, and cannot have an H-1B tranfer or change of status.

A new employer can file a H1B petition for you, and if approved, it will be approved for consular processing abroad.
