Legal Question in Immigration Law in Texas

HI,

My wife is in USA on H4 visa. and she received my H1-B approval (I-797B) recently.

Does she need H1B Visa stamping as it's just change of status?

If yes then can we go to Canada for Visa Stamping? In approval I 797B they mentioned Class Consulate or POE: H1B New delhi, COB: India.

I didn't see your approval and paperwork, and cannot comment on your particular circumstances.

However, generally, IF it was approved as a change of status, she doesn't need to travel abroad for a visa stamping. IF, however, it was approved for consular processing, she will need to travel to an appropriate US consulate and apply for a visa.

You should discuss it with your attorney, the one who assisted with the H-1B application process.
