HIV and IMMIGRATION

Does testing positive on your immigration physical automatically disqualify you from getting a green card or ever becoming a citizen? I am married to a US citizen and have been fearing getting my immigration physical or even applying for residency because im afraid of getting denied or having my status, if positive exposed to everyone, including my spouse.

Your question causes concern that you do not know if you are positive -- you need to find out; and your wife must be told the results. She is entitled to protection.

HIV is no longer an automatic bar, as you can submit a waiver request. The request must demonstrate that your admission poses minimal public health danger, minimal possibility of spreading infection, and will pose no cost to government agencies.

Each case is reviewed on a case-by-case basis.
