Re: marriage laws

If she is in the United States, then you file a Petition for Alien Relative, and a simultaneous Application for Legal Permanent Residence. There are supporting forms and documents to attach. You have to establish the legitimacy of the marriage and your financial stability. After an interview with USCIS, if approved she obtain status as an LPR.

If she is in Canada, then the Petition is filed with USCIS, and if approved, forwarded to NVC for processing as an LPR. Sometimes a fiancee visa is also filed to expedite the process.

If the process is confusing, hire an immigration lawyer to prepare and file on your behalf. Immigration is a national practice, and it is not necessary to be in the same locale.
