Legal Question in Immigration Law in Texas
Can a minor child with Canadian citizenship that one parent lives in Quebec and the other in New york both have full custodial rights when the minor was in new york her mother was killed and now she is seeking asylum with the allegations of her father (canada) being abusive. Uncle in California is helping her (minor age 14) seeking to keep her her in the US. Basic question is does minor file petition or does the uncle ( he does have to sponsor her) .... help clarify please.

You need to consult an immigration lawyer. This is not a basic question. What petition an uncle wants to file for a niece (it's not clear from your post)? An uncle can't file any petition for a niece.
What kind of abuse allegations the teen has? What was her mother's immigrant status (visa) in USA? etc.
