Hi, my mother who has citizenship scheduled this month, would like to help me, his adult unmarried son, to become a lawful resident. Unfortunately, I am out of status for 10 months and my mother did not file any petitions for me before. what can we do?

If you are over 21, it seems that you will not be eligible for adjustment of status (green card) through your mother's petition anyway. If you are out-of-status, the wait time in your visa category is several years. You can be eligible for consular processing of a visa in the future when a priority date is current. However, at that time, because of unlawful presence, your visa application can be denied.

You shall consult an immigration attorney in order to plan the best course of actions.
