Legal Question in Immigration Law in Texas
Here's My Status: I Am A Mexican Citizen. I Entered The U.S. Legally. I Married A U.S. Citizen. My Visa And Passport Expired. I Have A Kid Born On U.S. Grounds. My Wife & I Decided We Do Not Want To Live Together Anymore. I Am With My Kid Most Of The Time 90+%. It Is Illegal To Work In Many Places For An Alien So I Struggle To Keep Food, A Roof And A Blanket For Me And My Kid At All Times. Ex-Wife Gets Pregnant By Other Man. TX(where we live) Divorce Laws Get Complicated. What's The Best Thing To Do If I Want To Continue Raising My Kid Without Being Afraid Of Being Deportedor Losing My Kid's Custody? I Would Love To Become A U.S. Citizen, For I Have A Lot To Offer. I Just Don't Know What To Do To Solve My Legal Status Problems... Thanks For Your Time.

You can become permanent resident if your US citizen wife petitions for you, and you can prove that your marriage is bona fide. Unfortunately, your minor US citizen child can't help you to adjust status until her or she is 21. Since you are out of status (illegal), there are not so many legal options available to you.
