Legal Question in Immigration Law in Texas
My wife is in the process of getting her papers but wants to visit her parents in mexico. Can she apply for a pass to visit them without getting in trouble on the cross back to the us.
1 Answer from Attorneys
No, she should not travel abroad unless she has an advance parole and has always been legal in USA.
What is her visa/status in the USA? If she is legally in USA and have ALWAYS maintained her legal status, and now is waiting for adjustment of status, then, yes, she can apply for an advance parole (travel document) and can travel. Otherwise, she shoudn't travel abroad until her green card is approved, provided she is eligible for one.
