Do I have a copyright release since I now own the negatives?

I got married in May 2003 and hired a professional photographer. It was specified in our contract that after 1 year, the negatives would be given to my husband and I. Since then, the photographer has closed his business, filed bankruptcy and is claiming that he cannot find the negatives and is frankly unwilling to do anything about it. I contacted the photo lab and they still have the digital scans of my negatives and are willing to give them to me if I have a copyright release. Does the fact that it was written in our contract that the negatives were supposed to be given to us after 1 year of our wedding(which has passed) constitute a copyright release?
