Legal Question in Intellectual Property in Texas

My mom is being charged with fraud for using a counterfeit twenty dollar bill and I'm pretty sure everyone says there innocent but she is but the cops were not lettin her explain her self like where she had recieved it from and this is her 1st offense ever and i belive are 6th amendment is innocent until proven guilty but the just took her and now shes facing a felony do we have a case can we sue?

I also don't knowwhat subject of law this is fall under. Thank you for your time.
