Legal Question in Employment Law in Texas
Employer reference after termination
I worked at a university as an exempt employee @$45K annual in 1997. I was terminated after 7 mos & given 78 days severance pay. I'm not upset that I was terminated (''You just aren't working out'' reason) because I had already decided that I needed to get away from these people. I have a graduate degree & 17 years experience in the field. Now, I am self-employed. Another former employee who had been terminated shortly after me, told me that I sabotaged the computer system the evening that I left. I have never been able to get potential employers to substantiate this but I believe that they are telling people this! I have had interviews where they have been VERY interested & even state that I'll be invited back for a second interview, but it never materializes. When I try to follow up, I can't get a straight answer. Is there any way to find out what is being said about me? Is there any way to stop them from doing this? Is there any way to get damages for lying about me? I moved 1000 miles to take that job! The person who replace me was my subordinate who made my life a living hell for those 7 months because she wanted the job in the first place. She is still working there.

Re: Employer reference after termination
Several possibilities:
1) retain the services of reference checking service;
2) take a pre-suit deposition of individuals who heard the slanderous remarks and decided not to hire because they believed what they were told by the previous employer.
