noncompetition clause

I worked for the same company for over five years as a route saleperson. When I was hired, I signed a contract that had a noncompetion clause. It stated that ''if the employee ceases employment with (the company)'', I could not go to work for a competitor for a period of one year. I was ''let go'' (in the words of my former boss) because he felt my sales were not enough.

I have been employed in the same type of business for over 20 years. I was employed by my previous employer for over 14 years. If I would have quit, I could understand this noncompetion clause, but because they let me go, can they hold me to it? If so, I would be unable to apply for the same kind of job I have been doing for most of my life.

If you put it that way, No. Texas Courts are reluctant to enforce overbroad non-compete agreements that restrict people from pursuing their livelihood.
