Legal Question in Employment Law in Texas
I was working at a company that decided (due to internal politics) to close their Houston office and consolidate everything in their Norfolk, VA office. No offer was made to allow us to transfer to the norfolk office. After the "layoffs" were announced, the CEO produced an NDA and asked everyone (including those being laid off) to sign it. There has been no consideration offered for signing it. I have not signed it and now my last day of employment there has passed, I am being pressured to sign it. I have been told that my final paycheck will not be processed until I sign it.
Can they legally withhold the paycheck I have earned because I refuse to sign an NDA they produced at the last minute?

No!
Tell them as plainly as you can that you will not sign the agreement, and that if they don't pay you, you will file a complaint with the TWC. Take a look here:

And tell them I said they're dirty scumbags for even threatening to withhold a paycheck.
