Legal Question in Military Law in Texas

What course of action is best?

My cousin has served 7 years in the army so far, he's been to Iraq twice already and is supposed to go for another year and a half soon. In the past 4 months, he's been withdrawn, and severely depressed. He was recently promoted to either Sergeant or Staff Sergeant. I talked to my cousin today and last night he had a melt-down, he broke everything in his house, and was talking of suicide. He needs medical and mental help, and being sent back over will only push him over the edge. What can he do without getting a dishonorable discharge? His health and mental stability is the most important thing here and I do not want to lose him, but I know if he loses everything he's worked for, that also will push him over the edge. Please offer any advice at all. Thank you.

Re: What course of action is best?

Your cousin should request a discharge or separation from the military. He can contact me if he needs help.

Your brother has a severe case of PTSD. First of all he needs medical help. Go to the Army and have him seen for counselling and possibly medication. If they won't do anything for him, then tell him to see a private doctor especially a psychiatrist who can counsel him and provide needed treatment. I have seen this before in grunts that I served with in Vietnam many years ago. He is excessively stresses out.

Secondly, after he is medically stabilized, apply for a medical discharge from the Army.

Good Luck!
