Legal Question in Personal Injury in Texas
I have a case currently open about a vehicle collision...The insurance that I am suing claims that the defendant did not have insurance at the time of the accident but the defendant bank account had sufficient funds at the time to cover the insurance for the month...The insurance is claiming that the defendant's check had bounced because of insufficient funds what can I do and is this considered insurance fraud on there behalf

It sounds like the insurance was not in force due to non-payment. You can still sue the individual, but he probably doesn't have anything if he can't make his insurance payments. As long as your damages are $10K or less, you can do it in small claims court. If you have collision insurance, turn it in on your own insurance.
