Re: Changing lawyers

I always recommend that a client attempt to work out their differences with their attorney before changing lawyers. However, if you simply cannot resolve your conflicts, you do have the right to change lawyers. You need to write a letter to the attorney, terminate his services, and request a full copy of your file. Bear in mind that you have signed a contract with your attorney, pledging a portion of the settlement to the attorney. If the attorney feels you have terminated him without good cause, he may insist on enforcing the contract and being paid his fee upon settlement of the case. Normally, your new lawyer can strike an agreement with your former lawyer to split the fee.
