Legal Question in Personal Injury in Texas

Corporal Punishment

My son(6 yrs. old) was given corporal punishment for saying a spelling test was borring. My wife and I had already told the school district that we did not believe in hitting children with boards. They gave my son one swat striking him on his leg not bottom, leaving bruises and whelps. We took pictures, called the police, newspaper, and t.v. This has had a very adverse reaction on my son. The punishment and interrigation he was given made him litterally terrified of his teacher (the princable's wife) and the princable himself. It was later found out by my wife and I that they give 5 spankings a week in a school of 200 and even has held students down to give swatts. Can I sue for the bruises left on my son for over a week?

Re: Corporal Punishment

Schools have some immunity, however they still must act reasonably. It is of my opinion that you have a suit if all the facts you stated can be proved. Damages may be an issue. Have the child seen regularly by a psychologist and get that doctors opinion.
