Apartment complex neglects property which affects my property

My aunt is a home owner that has an apartment complex next door. For several months there has been what appears to be a seward back up coming from the apartments leading onto the front yard. There has been an outrageous odor... to condoms floating on her front yard. The City of Houston has been called and it appears the owner of the complex was ordered to fix the problem as we went a couple of weeks without seeing any condoms nor smelling an odor however, the problem has began again. Is there something that my aunt can do as a property owner? What rights does she have?

Yes, your aunt most likely has causes of action for nuisance, trespass, and quite a few others. She should probably first get an injunction against the apartment complex, and then sue for damages (reduced property values, etc) It is important that she document everything as much as possible, with video and photographs, etc. She should also retain counsel immediately, as I'm sure she needs to get this taken care of immediately.
